What is a medicolegal report?

A medicolegal report is an independent psychiatric assessment prepared for a legal, insurance, or workplace process — rather than for ongoing treatment. The psychiatrist conducting the assessment acts as an independent expert, forming an objective opinion based on clinical interview, history, and relevant documentation. These reports are typically requested by solicitors, insurers, employers, or bodies such as WorkCover Queensland.

Why patients are referred for an assessment

You may be referred for a medicolegal assessment if you are involved in one of the following.

  • A workers' compensation claim involving psychological injury
  • A Total and Permanent Disability (TPD) or income protection insurance claim
  • A workplace fitness-for-duty or return-to-work assessment
  • Personal injury litigation where psychiatric harm is being considered

What happens during the assessment

A typical medicolegal assessment follows five stages. Complex matters may need additional time or further documentation review.
